ToneelTickets is an online service that allows theatre companies and similar organisations to manage their ticket sales, seating plan, cash sales and access control. These terms apply to any use of the platform, both via the public ticket shop and via the admin panel.
ToneelTickets is a service of MVC Consulting, Deken Degryselaan 16, 8500 Kortrijk, VAT BE0533.693.208. For questions or complaints: info@toneeltickets.be.
1. Privacy and personal data processing
By using ToneelTickets the organisation also accepts the data processing agreement. The organisation acts as data controller and owns its own data; ToneelTickets acts as processor. See also our privacy policy.
2. Termination
The organisation may stop using ToneelTickets at any time. On simple written request we delete all data within at most two months. Outstanding amounts remain due.
ToneelTickets may suspend or terminate its services in whole or in part in case of a breach of these terms.
3. Terms of use
The organisation undertakes to use ToneelTickets:
- not for activities or purposes that breach applicable law or that may damage the reputation of ToneelTickets or its partners;
- only with accurate, reliable and complete data (association, contact, VAT number, shows, prices…) and to communicate changes timely;
- not for pornographic or material unsuitable for minors, gambling without licence, weapons, illegal activities, fraud, phishing or spam.
In case of suspected breach we reserve the right to refuse or terminate the service, without any compensation.
4. Emails and spam
It is forbidden to send unsolicited emails (spam, phishing, imported address lists) via ToneelTickets. Placing orders with non-existent email addresses or with addresses of people who did not consent is also forbidden. In case of breach the organisation owes a flat damage of €10 per email sent, compensating reputation damage to our mail domains and IPs.
5. Fraud
The organisation is responsible for any fraud occurring on its sales pages or with online payments. ToneelTickets is never liable for this.
6. Pricing and invoicing
Current rates are always visible on our pricing page. ToneelTickets may adjust these rates subject to at least one month's prior notice. Adjustments apply only to future productions.
After the last show of a production the organisation receives one clear invoice with the setup fee and the price per online ticket sold. Cash sales are free and not charged. All amounts are excl. VAT, unless stated otherwise. The organisation is responsible for correctly communicating its VAT status.
7. Payments via Stripe
Online payments are processed directly via Stripe. Stripe pays revenue to the organisation's own account, on the basis of a separate agreement between Stripe and the organisation (Stripe onboarding / KYC). ToneelTickets does not sit in this money flow and is not a party to that agreement.
Stripe's transaction fees (Bancontact, iDEAL, card…) are withheld directly by Stripe. Indicative rates are listed on our website; Stripe's current rates always apply.
Costs related to chargebacks, reversals or fraudulent transactions (e.g. payments with stolen cards) are entirely at the organisation's expense. In case of a sudden or significant increase in chargebacks, ToneelTickets reserves the right to temporarily suspend payouts pending investigation.
8. Cancellations and refunds
The organisation manages cancellations itself, preferably via automatically generated vouchers. ToneelTickets does not perform refunds via Stripe; actual refunds are settled by the organisation directly with the visitor.
9. References
ToneelTickets may mention the name and logo of an organisation on its website or in marketing material, possibly with a screenshot of the ticket shop. On simple request via info@toneeltickets.be we remove the mention.
10. Liability
Without prejudice to mandatory legal provisions, ToneelTickets is only liable for damage caused by intentional or gross fault or by fraud. Our liability is in any case limited to a maximum of the amount the organisation paid to ToneelTickets in the twelve months preceding the damaging event.
We are only liable for direct damage. Indirect damage, including consequential damage, lost profits, missed savings or damage to third parties, is expressly excluded. In case of force majeure our obligations are suspended.
11. Warranty
The software is provided "as is", without any express or implied warranty of merchantability, fitness for a particular purpose or non-infringement. ToneelTickets cannot be held liable for any claim or damage arising from the use of the software, except as provided in article 10.
12. Applicable law
These terms are governed by Belgian law. Disputes fall under the exclusive jurisdiction of the courts of the judicial district of the registered office of MVC Consulting.
